Here is the real question...If a tree falls in your backyard and no one is around to see it does it still make a noise?

Yeah. I just found this from MyLawyerinOklahoma.com.

Q: "I have a tree that has grown a substantial limb over my neighbors yard. What responsibilities do I have to them for that limb?"

A: If the tree is healty and in a safe condition your obligations are few. Acts of God that take down a limb would not be considered your responsibility. However, if the tree is dead or diseased any damage that falling limb does IS your responsibility. Moreover, if the damage or disease is obvious you open yourself up to the possiblity that the claim that you intentionally allowed the damage to take place. My reccomendation is, if in doubt keep the tree trimmed, even above your neighbors property, and if the tree is dead or diseased consider calling in an arborist to remove the dead or diseased areas.

P.S. if your neighbors tree is encroaching on your property you do have the right to trim that portion that is over your property so long as you can do so from your property and without killing or damaging the tree.

This is a Washington example, but I think that it probably applies here too...(caveat-absolutely no Oklahoma reserch was done. Consult your local attorney)

My tree fell on the neighbor's property. Am I responsible?

Probably not, if the tree was healthy, real estate lawyer Jeffrey Nadel said. "Trees are falling in our area because the ground is saturated. You are not responsible for an act of God, because if you were, you would be God."

Somin concurred. "If a tree falls, it's not always categorically the responsibility of the owner. My inclination is that if you were not negligent, then you are not legally responsible for damage caused by your tree."

You are negligent if the tree was diseased or somehow unsafe.

Sorry Patrick...

I think fault is based on who owns the tree, so your neighbors should be liable for the damage.

Hmmn. What about the Young and the Restless.

Anyway, I'm typing this from my parents house. They have power, and more importantly, heat.

And Tony was right. Two trees from two different neighbors yards have crashed in my backyard. One tore up a fence. Who's fault-and financial responsibilty-is the clean up!

One of you call channel 4 and tell them that the Mike Morgan robot is looking a little frayed and needs a tune up before putting him back out for another fifteen hour shift.

Crap. I specifically told God to hold off on the storm until it could interrupt the next Justice League post. Seriously - let it die.

Oh, and more hot chicks.

Otherwise I may be forced to cancel my subscription.
