About the high school coach who slept with the 18-year-old student…

Happy Monday, Oklahoma. I hope you’re on the first day of a short work week. If so, that means today is actually Wednesday, or — if you’re smart and take your PTO around a holiday — a Thursday of Friday. If that’s not the case for you, go find a government or corporate job. Anyway, let’s start this week of Thanksgiving with a light-hearted topic…rape!

A former Hennessey girls basketball coach has pleaded guilty to two felony charges of second-degree rape for having sex with an 18-year-old student at the school.

The Enid News and Eagle reports that 33-year-old Ben Davis Forsythe was sentenced to 90 days in the Kingfisher County Jail and 10 years of probation after entering the plea Friday in district court.

The plea and sentence are the result of a plea deal with the district attorney’s office that was reached after Forsythe’s challenge to state law defining rape was rejected.

Forsythe admitted having sex with the then 18-year-old girl.

State law prohibits sex between a student younger than 20 and an employee of the student’s public school or vocational system who is older than 18.


I don’t want this to come across like I’m defending the perv, but outside of prostitution, how can it be a crime for a consenting adult to have sex with another consenting adult? I get the fact that what he did was tacky and gross, but the girl was 18. She could buy cigarettes, vote for the President, join the army, and be sentenced to the death penalty, but…she couldn’t have consensual sex with her high school basketball coach.

In know…I know…it’s not that simple. The sicko was her high school basketball coach! He was in a position of authority. He could – and probably did – use his influence to brainwash her a bit. He’s a perverted loser who should never coach or teach in public schools ever again. He has to be guilty of something, right?

Then again, she’s 18. She’s technically a grown up. I mean an 18-year-old sorority girl can hook up with the 32-year-old assistant football coach and they’d both think it’s cool, but when you slightly change their titles, it becomes a crime.

Anyway, I’m not sure how I really feel about this whole thing. I’m just glad I don’t have to worry about it. I guess that’s the advantage of only dating 21 to 24-year-old European fashion models. By taking that precaution, I avoid awkward moments such as engaging in intelligent conversation, pretending to care about what someone did all day or being charged with 2nd-degree rape. Maybe the perverted douche bag high school teachers should do the same.


  1. Even if it’s consensual between a teacher and student, by law the student has to be 20.

    “Where the victim is at least sixteen (16) years of age and is less than twenty (20) years of age and IS A STUDENT, or under the legal custody or supervision OF ANY public or private elementary or secondary school, junior high or HIGH SCHOOL, or public vocational school, and engages in sexual intercourse with a person who is eighteen (18) years of age or older and is an employee of the same school system.”

  4. After reading the Enid article about it, it seems like this is a textbook example of WHY it’s illegal to sleep with your high school students, even if they are 18. Basically, he texted her over and over and she reluctantly met him somewhere and she said “we shouldn’t do this, you’re married” and then she did anyway after he convinced her to.

    Maybe that sounds like “how I get lucky on the weekends” to many of you, but when you’re 33 and talking to one of your basketball players, it might just have more than a twinge of undue influence.

  5. OK, I sort of get the position of influence arguement, but how the law is written, if you just happen to be a teacher, say of elementary students and meet a 19 year old girl with a fake id at a bar – BAM 2nd degree Rape. Sounds about right for Oklahoma though. We are TOUGH on CRIME.

    • Yep. THAT result would be ridiculous. I just don’t buy that “high school sports coach texts and calls his player, gives her beer and then has sex with her” as the sort of thing that definitely ISN’T rape.

  6. Wait a minute, you’re in a position of low pay, summers off, and if there is a small chance of any bad weather you get the day off, BUT you can’t screw the 18 year olds you’re teaching. Wow, teachers really do get a raw deal.

  7. The law is intended to keep teachers from using our schools as their own sexual playground. Those of you raising teenagers may appreciate this. Plus it puts the rest of the pervs that aren’t teachers at an unfair disadvantage because the don’t have that “influence” over their victims.
